These are the rules for using Fudakan with an account. By creating one, you accept them.
1. Who offers the service
Fudakan is a project by Arnau Miquel Fuster and Gabriel Moreno Martínez. Their full details are in the legal notice.
2. Your account
- To create an account you must be 14 or older.
- The account is personal. Look after your password and don't share it: anything done from your account is understood to be done by you.
- Use an email that is yours: you'll need it to confirm the account and to reset your password.
3. What Fudakan offers, and at what price
With your account you can mark the cards you own, the ones you trade and the ones you want, build binders with any cards you like, whether you own them or not (and decorate them with prints and your own images), set up your showcase, share your profile, see who has the card you're missing, comment on other people's binders, save the ones you like to come back to anytime and chat privately with your friends (the people you follow who follow you back). Without an account you can browse the website and build a trial binder, which is saved only in your browser. Fudakan is free: there are no fees, purchases or payments of any kind.
Fudakan doesn't sell cards, doesn't appraise them and doesn't take part in trades or sales between people: it only helps you find out who has or wants each card. The prices and collection value it shows are indicative (Cardmarket's trend price, which doesn't distinguish language, condition or edition): they are not an appraisal or an offer, and shouldn't be your only reference for buying, selling or trading. If you agree a trade with someone, you do it on your own, outside Fudakan and at your own risk. If you are a minor, don't meet anyone or send anything without a trusted adult knowing.
4. What you publish
Your name, your username, your bio, your contact details, your collection, the names of your binders, your comments and the images you upload are your choice, and you are responsible for them. By keeping your profile public, you authorize us to show them on Fudakan to anyone who visits your profile; that authorization ends when you make it private or delete your account.
5. Images you upload for your binders
You can upload your own images (up to 20) to use as prints among the cards in your binders. Before saving them, the website shrinks them and re-encodes them in a lightweight format; this removes anything hidden in the original file, such as the place where a photo was taken.
- They remain yours. By uploading an image you give us permission (free, non-exclusive and worldwide) to store it, resize it and show it on Fudakan for as long as you keep it uploaded. Nothing more: we don't sell it or use it outside the website.
- If you share it with the community (on by default; you can turn it off when uploading or later), it appears in the print gallery with your username, and other people can put it in their binders and download it for personal use. If you stop sharing it or delete it, it disappears from the gallery and from other people's binders. We can't recover copies that someone has already downloaded.
- Only upload what you can share: images made by you, or that you have permission for from whoever made them, or that are in the public domain. Adding the author's name or a link does not amount to having their permission.
- Not allowed: nudity or sexual content; violence, hate or harassment; photos showing people (not even yourself) or personal data; advertising; anything illegal; or other people's works without their permission.
- If you download someone else's image, it's for personal use and it's up to you to check that you can use it and to respect what its author asks. The images in the gallery don't belong to Fudakan.
How it's monitored. Images aren't reviewed before being published: they are reviewed when someone reports them. Every image has a “Report” button; with three reports from different people it's hidden automatically until we look at it. You can also write to [email protected] without an account: if you are the author or rights holder of an image, tell us which one and we'll remove it.
We can hide or delete any image that breaks these rules, revoke upload permission from anyone who breaks them and, in serious or repeated cases, close their account. If you think we removed one of your images by mistake, write to us and we'll look again.
6. Community rules
Fudakan is a place to enjoy a hobby. To keep it that way:
- Respect. No insults, harassment, threats or hate messages, including in your profile's name or bio, in your binder names, in comments, in private messages or in the images you upload.
- Be yourself. Don't pretend to be another person, a shop or a brand.
- No cheating. Don't mark cards to deceive someone in a trade.
- No advertising or spam. Your profile isn't a shop window.
- Nothing illegal. Don't publish content that breaks the law or other people's rights.
- Look after your data. Don't put your phone number, your address or other people's details on your profile. If you write how to contact you, make it a social network or messaging username, never something that lets someone locate you.
- Don't abuse the system. Don't try to access other people's accounts, automate requests or overload the service.
If you see a profile that breaks these rules, let us know at [email protected]. If it's an image, a comment or a private message you received, use its “Report” button. To stop someone from being able to write to you, unfollow them.
Comments and messages. Comments on a binder can be seen by anyone who can see that binder; they can be deleted by whoever wrote them and also by the binder's owner, and with three reports from different people they're hidden automatically until we look at them. Private messages can only be seen by the two people writing to each other, and only people who follow each other can exchange them: we don't read them, except for a specific message when the person who received it reports it. We can delete comments or messages that break these rules, remove an account's ability to comment and write and, in serious or repeated cases, close it.
Missions, stamps and rewards. The stamps, frames, titles and other decorations earned by using the website are just that, decorations: they have no monetary value, can't be bought or sold and can't be transferred to another account. We can change the missions and what they unlock, and remove those earned by cheating or with fake accounts.
7. Fan project and trademarks
Fudakan is an unofficial fan project, unrelated to Nintendo, Creatures Inc., GAME FREAK inc. or The Pokémon Company. The card names and images belong to their owners. Having a Fudakan account gives you no rights over those images.
8. Closing your account, and when we can close one
- You can delete your account whenever you like, without giving any reason, from your profile (“Your account” → “Delete my account”). Everything is erased right away.
- We can suspend or delete an account that breaks these terms or the community rules. Except in serious cases, we'll give notice by email first.
9. Availability and liability
Fudakan is provided as is, as a hobby project. We do our best to keep it working well and not to lose your data, but we can't guarantee it will always be available, and it may change or close. If it ever closed, we'd announce it on the website in advance.
The card data comes from a third-party project and may contain errors. What each person publishes, including the images they upload, is their own responsibility; when we're told about something that shouldn't be there, we remove it.
Nothing above limits the rights the law gives you as a consumer.
10. Changes to these terms
If we make significant changes to these terms, we'll announce them on the website in advance. If you don't agree with the changes, you can delete your account.
11. Applicable law and contact
These terms are governed by Spanish law. If you are a consumer, any dispute will be resolved before the courts of your place of residence. For any questions, write to [email protected].
